Does anybody know what the entitlement to Annual leave and bank holidays are when you are on maternity leave. I have been on 6 months full pay and then 3 months statuatory pay. My manager seems to think that I am not entitled to accrue anything for the last 3 months. Or can anyone guide me in the right direction.
by law you accrue holiday whilst on maternity leave, just as you would if you were at work- so get your employer told!
our holiday year runs jan - dec im starting maternity leave in april - dec so still have a whole years holiday allowance as well, and i only work part time.
think it might be slightly different if you were planning on not returning to your job afterwards, as you'd only accrue holiday until the end of your maternity leave.
here's a link to the working families website, hope this helps.
My work tried to fob me off too about my holidays! I ended up getting 6 weeks full pay then the rest smp until Ben was 6 months & then went back to work as OH lost his job & I had t. no choice but to return.
When I went back they tried to tell me I wasn't entitled to my holiday pay from while I was on maternity leave but in the end I said I would get the union involved & they turned round & paid me straight away for 5 weeks holiday then because I went back in the April our holidays start from April so I got another 5 weeks to take through the year which was nice!
Hope you manage to get things sorted soon, you have enough to worry about without work being a pain in the backside too.

KalyJade and Michelle are totally right. The law says you accumalate holiday and receive your usual benefits as if you were at work. This includes payrises, if you receive one whilst you are on maternity leave you are entitled to have it backdated. Check out the employees section of the Inland Revenue website for all the other points.
If your employer still argues then talk to the Citizen Advice Bureau.
Hope this helps Julie x

You accrue holiday in the normal way during ordinary maternity leave and then accrue statutory holiday (which currently stands at 24 days but this includes bank holidays) entitlement on additional maternity leave. Confusing but hope this helps you go back to your boss and tell him you do have the right to some holiday Loocy xx
Thank you everyone, its always useful to have the websites to check as well. You would think I work for some small employer but actually I am a civil servant and even the HR department have said I am not entitled to anything. One would have thought they should know better but I shall go armed with all my facts...thanks again.
I meant to say, to confuse even further, that there's no set rules about whether or not you can carry leave over to a new leave year while you're on materntiy leave as technically you aren't allowed to carry statutory leave over (whether you're on mat leave or not) so that is very much down to your employer and their policy. I would have thought the civil service would have had really good policies, though. It just goes to show, doesn't it!?
i am aslo civil servent and due to go on mat leave april 08 i get 6 months full pay then 3 months statuory then can take a further 3 months unpaid. it is written in our staff handbook that due to us getting 6 months full pay we only acrue holiday for that time period we are on ful pay. when you go down to stat or no pay we are no longer eligiable to acrue holiday. it also says you can carry 9 days over to the next leave yr. cuz my leave yr runs jan -feb i am having 6 months full pay then should have acrued about 6 weeks holiday by then (inc bank hols) and am adding it onto my 6 months full mat leave if that makes sense so i dont have to drop to stat pay.
